InFocus Ultrasound is committed to protecting the confidentiality of your health information. Except as described in this Notice, InFocus Ultrasound will not use or disclose your health information without your written authorization. Your health information may be used for the following purposes:
Delivery of services. InFocus Ultrasound may use and disclose your health information for treatment purposes including the delivery of healthcare services, defined as those activities necessary for the provision of services and the delivery of results. For example, we may use your personal information to schedule your appointment and interpret your results. At the site, an employee of InFocus Ultrasound may call your name for your appointment
Healthcare operations. InFocus Ultrasound may use your health information for the purposes of its healthcare operations. Healthcare operations may include quality assessment, protocol development, review of competence/qualification of InFocus Ultrasound staff, training programs, conducting or arranging for medical review, legal services & auditing functions, and general administrative activities, including management actions relating to HIPAA, customer service, resolution of internal grievances, and creation of de-identified information.
Payment. InFocus Ultrasound may use your health information for payment purposes if applicable. For example, a bill may be sent to you or your health plan to seek payment for the health care services provided by InFocus Ultrasound to you. The bill may contain or be accompanied by information that identifies you, your health condition, and the healthcare services you received. We may also use your health information to check Medicare/insurance eligibility and for other purposes related to payment.
Appointment reminders and test results. InFocus Ultrasound may contact you to provide appointment reminders, test results or, subject to applicable law, to give you information about treatments or health-related services that may be of interest to you. This may include voice mail messages, texts, postcards, letters, e-mail and other forms of communication.
Research. Under certain circumstances, InFocus Ultrasound may use your health information about you for research purposes. However, no information will be provided to a third party without your authorization. Research projects are subject to a special approval process during which protocols for appropriate protection of your health information are established.
Family and friends. With your approval and using our professional judgment, your health information may be disclosed to family or friends who are directly involved in your care. If you are unavailable, incapacitated, or in an emergency medical situation, and we determine that a limited disclosure may be in your best interest, we may share limited health information with such individuals without your approval.
Business Associates. In some instances, InFocus Ultrasound may contract with business associates for the services InFocus Ultrasound provides. For example, InFocus Ultrasound may use an outside company to mail results of your health services to you. InFocus Ultrasound may disclose your health information to their business associates so that they can perform the work that InFocus Ultrasound asks them to do. However, to protect your health information, business associates are required by law and by contract to protect the privacy of your information.
Other uses and disclosures of health information. We may use or disclose health information about you without your prior authorization for government or legal purposes, such as for public health purposes, required abuse or neglect reporting, health oversight audits or inspections, or in response to valid judicial or administrative orders. InFocus Ultrasound may also combine health information about many of its customers to decide which additional services should be offered.
Stricter Law. Certain provisions of state law may be more stringent than the federal laws and regulations protecting the privacy of your health information. InFocus Ultrasound will, as required by law, comply with the more stringent provisions of state law.
In addition to the uses and disclosures described above, InFocus Ultrasound may use and disclose your health information if you provide InFocus Ultrasound written authorization to do so. You may authorize InFocus Ultrasound to use or disclose your health information to anyone for any purpose. If you give us an authorization, you may revoke it at any time by delivering written notice of your revocation to the InFocus Ultrasound Privacy Officer at the address listed at the top of this notice. Your revocation will not affect any use or disclosure of your health information permitted while the authorization was in effect. Unless you give us a written authorization, we cannot use or disclose your health information except as set forth in this Notice. InFocus Ultrasound must obtain your authorization for any use or disclosure of your health information for certain marketing purposes and for disclosures that constitute the sale of your health information.
Restrictions on use and disclosure of health information. You have the right to request restrictions on certain uses and disclosures of your health information. These restrictions must be made in writing and signed by you or your representative. InFocus Ultrasound is not required to agree to your restrictions. We cannot agree to limit uses/disclosures that are required by law. In the event of a termination of an agreed-to restriction by us, we will not notify you of such termination. You may terminate, in writing or orally, any agreed-to restriction by sending such terminations to the Privacy Officer.
Access and/or copying health information. You have the right to receive a copy of your health information in InFocus Ultrasound’s possession. You have the right to inspect and copy your health information. If you request copies, we may charge a fee for the cost of copying.
Amendments to health information. You have the right to request that your health information be amended or corrected. InFocus Ultrasound is not required to change your health information. In the case that InFocus Ultrasound denies to make a change, it will provide you with information about the denial and the process whereby you can disagree with the denial.
Accounting for disclosures of health information.
You have a right to receive an accounting of disclosures of your health information made by InFocus Ultrasound, except that InFocus Ultrasound does not have to account for the disclosures for delivery of services or business operations as described above, information provided to you, or certain government functions described above.
Right to paper copy. You have a right to a paper copy of this Notice of Privacy Practices. If you would like to have a more detailed explanation of these rights or you would like to understand one or more of these rights, please contact the InFocus Ultrasound Privacy Officer listed at the top of this notice.
Breach of Protected Health Information. If there is ever a breach of your protected health information that is held by InFocus Ultrasound or one of its business associates, you will be notified in accordance with State and Federal laws.
Right to Revoke Authorization to Share Protected Health Information: To the extent you have authorized us to share your protected health information, you may revoke that authorization at any time by contacting the Privacy Officer by mail or email, at the address located at the top of this notice.
InFocus Ultrasound reserves the right to amend this Notice of Privacy Practices at any time in the future. Any amendments will be applied prospectively and will be made in compliance with applicable laws. Until such amendment is made, InFocus Ultrasound is required by law to comply with this Notice.

User Agreement and Terms of Service
General Provisions
This InFocus Ultrasound User Agreement (“Agreement”) constitutes a legally binding agreement between you and InFocus Ultrasound LLC, and its affiliates (collectively, “InFocus Ultrasound”, “we”, “us” or “our”). This Agreement governs your access to and use of the InFocus websites and services (the “Site” and the “Services”). The Service is offered and available to users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old and of legal age to form a binding contract with us. If you do not meet all these requirements, you must not access the Site or use the Services.
Information provided to you through the Site, or by your access to or use of InFocus Ultrasound products or services, should not be regarded as medical or health care advice or treatment. Always seek the advice of your physician or other qualified health care provider with any questions you may have regarding interpretation of your test results, or any other medical condition or health related issue you may have. In the case of a health emergency, seek immediate assistance from emergency personnel. Never delay obtaining medical advice or disregard medical advice because of information you accessed on or through or by way of this Site or Service.
You agree to comply with this Agreement, all applicable laws, and other applicable InFocus Ultrasound policies, practices, and notices provided or referenced herein at all times when using the Site or Service.
InFocus Ultrasound expressly disclaims all warranties and responsibilities of any kind, whether express or implied, for the accuracy or reliability of the content of any information contained in this Site or Service. While we have made a concerted effort to provide you with the best possible information, this website is not a substitute for a visit with your healthcare professional, and any reliance upon or use of this information by you is at your own independent discretion and risk.
InFocus Ultrasound may change or amend this Site or its product or service offerings at any time. Such changes will be effective immediately upon posting and will be communicated on this Site. Your continued use of the Service means that you accept these changes.

Screening Services
Because no screening test can screen for every possible condition, it is possible to have a normal screen with InFocus Ultrasound and still suffer from health condition. If you are experiencing symptoms of a life-threatening condition, SEEK MEDICAL ATTENTION IMMEDIATELY. Do not delay, regardless of your InFocus Ultrasound results.
Our screenings do not detect all forms of abnormal health conditions and do not result in medical diagnosis or replace regular contact and follow-up with your physician.
Insurance
InFocus Ultrasound does not participate in the Medicare program and the cost of our screening services is not covered or reimbursable by Medicare. InFocus Ultrasound does not file insurance claims nor provide referrals to any physician’s group or hospital.
Cancellation Policy
If you are unable to attend the screening for any reason whatsoever, we will issue a refund for screening services if provided 24-hour notice. A refund will not be issued for no-show no-call appointments.
Other Terms of Service
Communication – Mail, Email, Phone Calls and Texts
By using or purchasing InFocus Ultrasound services or products, or when you book an appointment, if you provide your contact information, you agree to receive information from us related to your InFocus Ultrasound appointments, products, or services. You may also choose to receive information or marketing content from InFocus Ultrasound related to our business or potential opportunities related to your health and well-being.
If you have any questions about receiving communications from us, please contact us directly. Note that obtaining services or products from InFocus Ultrasound is never contingent upon you agreeing to receiving marketing communications from us.
Intellectual Property
All Online and On-Site Services are owned by InFocus Ultrasound. None of InFocus Ultrasound related names, trademarks, service marks, copyrights and logos may be used without express written permission of InFocus Ultrasound.
Third Party Content and Linked Websites
WE DO NOT ACCEPT ANY LIABILITY ARISING OUT OF ANY ALLEGATION THAT ANY THIRD PARTY-OWNED CONTENT (WHETHER PUBLISHED ON THE ONLINE SITES, RADIOLOGY REPORTS, TECHNOLOGIST WORKSHEETS, OR VERBAL OR WRITTEN INFORMATION BY INDEPENDENT PROVIDERS AT INFOCUS ULTRASOUND) INFRINGES THE INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON OR ANY LIABILITY ARISING OUT OF ANY INFORMATION OR OPINION CONTAINED IN SUCH CONTENT, WEBSITES OR APPLICATIONS INCORPORATED INTO OR LINKED TO FROM OUR SITE OR SERVICE.
Severability
If any provision of this Agreement is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of this Agreement shall remain in full force and effect. Any provision of this Agreement held invalid or unenforceable only in part or degree will remain in full force and effect to the extent not held invalid or unenforceable. The parties further agree to replace such invalid or unenforceable provision of this Agreement with a valid and enforceable provision that will achieve, to the extent possible, the economic, business, and other purposes of such invalid or unenforceable provision.
Applicable Law
This Agreement shall be construed in accordance with the laws of the State of Oklahoma. Any dispute between InFocus Ultrasound and you related to this Agreement shall be resolved exclusively by the state and federal courts of the State of Oklahoma.
Limitation of Liability and Disclaimer or Warranty
THE ONLINE SERVICES AND ALL INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH OUR WEBSITE OR ON-SITE (COLLECTIVELY “SERVICES”) ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
ACCESS TO THE SERVICES MAY BE INTERRUPTED OR CHANGED, AND ANY INFORMATION INLCUDED WITHIN THE SERVICES MAY NOT BE FREE OF ERROR. INFOCUS ULTRASOUND DOES NOT WARRANT THAT THE SERVICES ARE ACCURATE, RELIABLE, COMPLETE, USEFUL, OR CORRECT; THAT THE SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED.
PLEASE NOTE THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THE EXCLUSION OF IMPLIED WARRANTIES.
UNDER NO CIRCUMSTANCES SHALL INFOCUS ULTRASOUND OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.
IN THE EVENT SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF DAMAGES TO THE EXTENT INDICATED ABOVE, OUR LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE SERVICES WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS.
